Terms of Service – iGlowly Assistant

1. Definitions
For the purposes of these Terms of Service:
- “iGlowly” refers to the iGlowly Assistant service operated by the founder of iGlowly within Jobyourself Coop SC, Belgium.
- “Assistant” refers to the iGlowly Assistant software widget embedded on clinic websites.
- “Clinic” or “Customer” refers to any clinic, medical practice, or business subscribing to or using the iGlowly Assistant on its website.
- “End User” refers to any visitor interacting with the Assistant on a clinic website.
- “Services” refers to the iGlowly Assistant, analytics dashboard, and related services provided by iGlowly.
- “Content” refers to clinic-provided information, treatment descriptions, prices, images, and any other material submitted by the clinic.
- “Guides” refers to iGlowly educational content and treatment information used by the Assistant.
2. Scope of the Service
The iGlowly Assistant is an informational software tool designed to:
- Provide general educational information about aesthetic treatments and procedures;
- Provide general clinic information such as services offered, opening hours, and practical information;
- Help visitors understand treatments before contacting a clinic;
- Provide anonymous demand analytics to clinics.
The Assistant is not:
- A medical device;
- A healthcare service;
- A diagnostic tool;
- A telemedicine platform;
- A patient communication system;
- An emergency service.
The Assistant provides general informational content only.
3. No Medical Advice
The Assistant does not provide medical advice, diagnosis, or treatment recommendations.
Information provided by the Assistant:
- Is general and educational;
- May not apply to a specific individual;
- Must not be used for medical decisions;
- Must not be used in medical emergencies.
If a user indicates symptoms such as severe pain, bleeding, allergic reaction, or other urgent conditions, the Assistant may instruct the user to contact emergency services or a medical professional immediately.
Always consult a qualified healthcare professional for medical advice.
4. Artificial Intelligence Disclaimer
Some responses generated by the Assistant use artificial intelligence.
The Clinic and End Users acknowledge that:
- AI-generated responses may be incomplete or inaccurate;
- The Assistant may occasionally produce errors;
- The Assistant does not replace professional medical advice;
- All information should be verified with a qualified professional.
iGlowly does not guarantee the accuracy, completeness, or suitability of AI-generated responses.
5. User Responsibility and Personal Information
End Users should not enter personal, identifying, or medical information into the Assistant.
The Assistant is not designed to receive or process personal data or health information.
If such information is entered, the system is designed to automatically detect and remove personal identifiers before processing.
The Assistant is not a communication channel with the clinic and cannot be used to send medical information, medical photos, appointment requests, or personal messages to the clinic.
To contact the clinic, users must use the official contact methods provided on the clinic’s website.
6. No Clinic Contact Requests Through the Assistant
The Assistant cannot send messages to the clinic and cannot be used to request a callback, send an email, book an appointment, cancel an appointment, or transmit personal information.
The Assistant may provide links or directions to official clinic contact methods, but it does not transmit messages to the clinic.
7. No Professional Relationship
Use of the Assistant does not create:
- A doctor–patient relationship;
- A healthcare provider–patient relationship;
- A professional advisory relationship;
- A contractual relationship between the End User and iGlowly.
Any medical relationship exists only between the patient and the clinic or healthcare professional.
8. Acceptable Use
Users and Clinics agree not to:
- Use the Assistant for illegal purposes;
- Attempt to hack, probe, or reverse engineer the system;
- Attempt to bypass security, rate limits, or safeguards;
- Upload malicious code, scripts, or malware;
- Use the Assistant for spam or automated scraping;
- Provide misleading or unlawful content;
- Use the Assistant in a way that may create legal risk for iGlowly.
iGlowly reserves the right to suspend access in case of misuse.
9. Clinic Responsibilities
Clinics are solely responsible for:
- The accuracy of their clinic information;
- Their prices, services, and descriptions;
- Their medical advice and patient care;
- Compliance with medical, advertising, and healthcare regulations;
- Their communication with patients;
- Any decisions made based on information provided on their website.
The Assistant is an informational tool only.
The Clinic remains fully responsible for all medical services and patient interactions.
10. Editorial Control and Content Review
iGlowly maintains editorial control over content displayed through the Assistant.
This includes:
- Review of clinic descriptions;
- Review of treatment and procedure listings;
- Review of pricing information before publication;
- Review of any custom treatments added by clinics.
iGlowly reserves the right to:
- Edit content for clarity, accuracy, or neutrality;
- Remove misleading, unverifiable, or exaggerated claims;
- Remove marketing language such as “best”, “#1”, or similar promotional claims;
- Refuse publication of content that does not meet editorial standards.
Content review may take up to 2 business days.
Clinics remain responsible for the factual accuracy of their information.
Promotional Mini Banner:
Certain paid plans may allow clinics to display a small promotional banner. Clinics are fully responsible for the content of these promotional messages. iGlowly does not verify and is not responsible for promotional banner content.
11. Third-Party Links and Clinic Contact Tools
The iGlowly Assistant may display links or buttons that redirect users to external services provided by the clinic, including but not limited to:
- Appointment booking systems
- Email contact links
- Telephone links
- WhatsApp contact links
- Maps and location services
- External websites
These links are provided by the clinic and may lead to third-party websites or software not operated or controlled by iGlowly.
iGlowly:
- Does not operate these external systems;
- Does not store or process information submitted through these external systems;
- Is not responsible for the availability, security, or privacy practices of these external services;
- Is not responsible for any data submitted by users on third-party websites.
When a user clicks on a booking link, email link, WhatsApp link, or map link, the user leaves the iGlowly Assistant environment and interacts directly with the clinic or a third-party service provider.
Users should review the privacy policy and terms of the relevant third-party service before submitting personal information.
12. Fees and Payment
Some Services are provided on a subscription basis.
- Subscriptions may be monthly or yearly;
- Payments are processed via third-party payment providers;
- If payment fails, a grace period of 5 days may apply;
- If payment is not received after the grace period, the Assistant may be suspended;
- If payment is not received after 30 days, the account may be terminated.
iGlowly may change pricing with prior notice.
13. Suspension and Termination
iGlowly may suspend or terminate access to the Services if:
- Payment is not received;
- The Clinic violates these Terms;
- The Assistant is used in a way that creates legal risk;
- The Clinic provides misleading or illegal content;
- There is abuse, hacking, or misuse of the system.
Clinics may terminate their subscription at any time.
14. Intellectual Property
The following remain the property of iGlowly:
- The iGlowly Assistant software;
- The assistant logic and system architecture;
- The iGlowly educational guides and content;
- The analytics system;
- The iGlowly brand and materials.
Clinics retain ownership of:
- Their clinic name;
- Their logo;
- Their clinic information;
- Their prices;
- Their uploaded content.
Clinics grant iGlowly a license to display and process their content for the purpose of providing the Services.
15. Service Availability
The Services are provided on an “as is” and “as available” basis.
iGlowly does not guarantee uninterrupted availability and is not responsible for outages, infrastructure failures, or third-party service failures.
16. Limitation of Liability
To the maximum extent permitted by law, iGlowly shall not be liable for:
- Medical decisions made by patients;
- Actions taken by clinics;
- Incorrect clinic information;
- AI-generated content errors;
- Third-party booking systems or external links;
- Loss of business, revenue, or profit;
- Indirect or consequential damages.
Where liability cannot be excluded, iGlowly’s total liability shall be limited to the amount paid by the Clinic for the Services during the previous 12 months.
17. Indemnification
Clinics agree to indemnify and hold harmless iGlowly from any claims arising from:
- Clinic medical services;
- Clinic advertising claims;
- Incorrect clinic information;
- Clinic pricing;
- Clinic patient disputes;
- Misuse of the Assistant by the Clinic.
18. Data Protection
Data processing is described in the Privacy Policy – iGlowly Assistant.
The Assistant operates under a data minimization and Zero-PHI architecture and is designed not to store personal health information.
19. Governing Law
These Terms shall be governed by the laws of Belgium.
Any disputes shall be subject to the jurisdiction of the courts of Brussels, Belgium.
20. Changes to the Terms
iGlowly may update these Terms from time to time.
The updated version will be published with a revised “Last updated” date.
