Acceptable Use Policy – iGlowly Assistant

This Acceptable Use Policy (“Policy”) governs the use of the iGlowly Assistant (the “Assistant”) by clinics, organizations, and their staff (the “Customer”). This Policy forms part of the Terms of Service and applies to all use of the Assistant.
1. Purpose of the Assistant
The iGlowly Assistant is an informational software tool designed to provide general, non-personalized information about treatments, services, and clinic-related information such as opening hours, general pricing information, and commonly asked questions.
The Assistant is:
- Not a medical device;
- Not a diagnostic tool;
- Not a treatment recommendation system;
- Not a patient communication platform;
- Not an electronic medical record system;
- Not a telemedicine system;
- Not intended for emergency use.
The Assistant may only be used for general informational and educational purposes.
2. Strict Prohibition on Personal and Medical Data Collection
The iGlowly Assistant must not be used to collect, store, transmit, or process:
- Personal data;
- Sensitive personal data;
- Medical information;
- Patient data;
- Protected Health Information (PHI);
- Medical records;
- Intake forms;
- Consent forms;
- Insurance information;
- Identification numbers;
- Photos or files containing patient information;
- Any information relating to an identifiable individual’s health condition.
The Assistant is designed to minimize data collection and must not be used as a form, intake tool, or data collection tool.
3. Prohibited Medical and Patient Communication Uses
The Assistant must not be used for:
- Providing medical advice;
- Providing diagnosis;
- Providing treatment recommendations;
- Patient-specific questions about symptoms or medical conditions;
- Post-procedure or post-operative instructions to specific patients;
- Reporting complications or side effects;
- Triage or urgency assessment;
- Emergency communication;
- Patient follow-up communication;
- Medical consultations;
- Patient intake or medical questionnaires;
- Collecting patient contact details;
- Sending prescriptions or treatment plans;
- Any doctor–patient communication.
The Assistant must not be presented to users as a medical professional, doctor, nurse, or medical authority.
4. Emergency and Urgent Situations
The Assistant must not be used for emergency or urgent medical situations.
Customers must ensure that their website clearly instructs users to contact the clinic directly or emergency services for urgent medical issues, complications, or emergencies.
5. External Links and Third-Party Services
The Assistant may display links provided by the Customer to third-party services, including:
- Appointment booking systems;
- Email contact links;
- Telephone links;
- WhatsApp or messaging links;
- Maps and location services;
- External websites.
These services are not operated by iGlowly.
The Customer is solely responsible for these external services, including their security, content, availability, and data protection practices.
iGlowly is not responsible for any data submitted by users on third-party websites or services.
6. Clinic-Provided Content
The Customer may provide content to be displayed through the Assistant, including:
- Treatment descriptions;
- Pricing information;
- Clinic information;
- Staff information;
- Custom treatment names;
- Promotional text or banners.
The Customer is solely responsible for the accuracy, legality, and compliance of all content it provides.
iGlowly reserves the right to review, edit, refuse, or remove any content that:
- Is misleading or inaccurate;
- Contains unverifiable claims (e.g., “#1 clinic”, “best in the world”);
- Violates advertising or healthcare regulations;
- Violates this Policy or applicable law;
- Creates legal, medical, or compliance risk.
7. Shared Responsibility Model
The iGlowly Assistant is a configurable informational tool. Responsibility is shared as follows:
iGlowly is responsible for:
- Providing and maintaining the software;
- Implementing security measures;
- Implementing data minimization and sanitization systems.
The Customer (clinic) is responsible for:
- How the Assistant is presented on its website;
- The instructions given to users;
- The content displayed in the Assistant;
- External links and third-party services;
- Compliance with medical, advertising, privacy, and healthcare regulations;
- Ensuring that the Assistant is not used to collect personal or medical data;
- Ensuring that the Assistant is used for informational purposes only.
8. No Medical or Professional Relationship
Use of the Assistant does not create:
- A doctor–patient relationship;
- A healthcare provider–patient relationship;
- Any professional advisory relationship.
The Assistant provides general informational content only.
All medical advice, diagnosis, and treatment decisions remain the sole responsibility of qualified healthcare professionals.
9. Compliance with Laws and Regulations
The Customer is responsible for ensuring that its use of the Assistant complies with all applicable laws and regulations, including but not limited to:
- Data protection and privacy laws;
- Medical and healthcare regulations;
- Medical advertising regulations;
- Consumer protection laws;
- Professional licensing rules;
- HIPAA and other health data regulations where applicable.
10. Indemnification for Misuse
The Customer agrees to indemnify, defend, and hold harmless iGlowly from and against any claims, damages, liabilities, costs, or expenses arising from:
- Use of the Assistant in violation of this Policy;
- Use of the Assistant as a medical advice or patient communication tool;
- Collection of personal or medical data through the Assistant;
- Content provided by the Customer;
- External links and third-party services provided by the Customer;
- Violation of applicable laws or regulations by the Customer.
11. Suspension for Misuse
iGlowly reserves the right to suspend or terminate access to the Assistant if:
- The Assistant is used to collect personal or medical data;
- The Assistant is used for patient communication or medical advice;
- The Assistant is used in violation of this Policy or applicable laws;
- The Customer fails to pay applicable fees;
- The use of the Assistant creates legal, security, or compliance risk.
12. Changes to This Policy
iGlowly may update this Acceptable Use Policy from time to time. Continued use of the Assistant after changes become effective constitutes acceptance of the updated Policy.
